2. Description of Service

NiTip is a creator tipping platform that enables content creators to receive tips from their audience via M-Pesa during live streams. The Service includes tip collection, on-stream alerts, and payout processing.

3. User Accounts

To use NiTip as a creator, you must:

• Be at least 18 years old or the age of majority in your jurisdiction
• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Be responsible for all activities under your account

4. Tips and Payments

Tips sent through NiTip are voluntary payments from supporters to creators. By using our Service:

• Creators acknowledge that tips are subject to applicable platform fees
• Supporters understand that tips are generally non-refundable
• M-Pesa tips processed through Paystack are subject to the applicable Paystack and M-Pesa terms.
• NiTip is not responsible for payment processing delays by third parties

5. Prohibited Content

You may not use NiTip to:

• Stream or promote illegal content
• Engage in fraud, scams, or deceptive practices
• Harass, abuse, or harm others
• Violate intellectual property rights
• Distribute malware or harmful code
• Circumvent platform restrictions or fees

6. Platform Fees

The Free plan lets you keep 95% of every successful M-Pesa tip. One 5% fee includes NiTip and payment processing, deducted before payout. We reserve the right to modify fees with reasonable notice to users.

Manage your payout details and check payment and payout status in your NiTip account. Contact support@nitip.africa if you need help with a payout.

7. Termination

NiTip may suspend or terminate your account at any time for violations of these terms or for any other reason at our discretion. Upon termination, your right to use the Service ceases immediately.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. NITIP DOES NOT GUARANTEE UNINTERRUPTED SERVICE, ACCURACY, OR RELIABILITY. USE OF THE SERVICE IS AT YOUR OWN RISK.

9. Limitation of Liability

NiTip shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount paid by you to NiTip in the past twelve months.

10. Governing Law

These Terms shall be governed by the laws of Kenya. Any disputes shall be resolved in the courts of Nairobi, Kenya.
